We’ve all gotten them – nice looking certificates that arrive in our mailboxes – usually at the end of winter when we’re starting to dream of spring break – advertising for a free vacation. Some certificates include lodging in a hotel or timeshare resort for a certain number of days and nights. Other offers include airfare or a cruise, or provide one complimentary ticket with the purchase of a second. Some certificates include discount coupons for restaurants, tours or attractions in the resort area.

Your momma taught you there is no such thing as a free lunch, right?  True here, too.  To start with, many require a non-refundable processing and handling fee or a refundable deposit of $50 to $100 to reserve a vacation offer.

But that’s not all you need to watch out for:

Read the rules carefully. Do you meet the required conditions, such as age and marital status or income level?

Determine all costs involved in using a vacation certificate. It will be your responsibility to pay for anything not specifically mentioned.   Will you be expected to pay for:

Hotel, timeshare resort or other lodging? Meals?

Transportation from your home to the resort? Do you have to travel to a distant location before the company pays for “free” travel?

Transportation from the airport to the lodging accommodation?

Additional fees for the peak tourist season? When is the peak season? Are there any port taxes when visiting a foreign country?

Timeshare Frustration Leads to Timeshare Relief

Exec VP of resort Sales and Marketing, David Gilbert, has said, “We’d like to see laws in place that protect consumers. . . its very good for Caribbean countries to implement constructive legislation, that is not so restrictive that developers can’t build and sell but structured so that it protects the consumer.”

Wyndham Plans to Introduce Days Inn and Super 8 to Australia

Wyndham Vacation Resorts Asia Pacific plan to increase timeshares from a current 43,000 timeshare owners to an unspecified amount. They will also be introducing the Days Inn and Super 8 brands to Australia and New Zealand.

Wyndham Vacation Resorts Asia Pacific, a part of Wyndham Worldwide corp. is planning to spend at least $20 million to develop properties of Days Inn and Super 8 brands in the Australia and New Zealand regions. The Gold Coast based company is looking to increase their timeshare owner customer base from the current 43,000 to an undisclosed figure goal.

Due to the global financial crisis Wyndham is focusing on controlling costs rather than increasing sales as the demand for timeshares has changed dramatically. The Asia Pacific business’s 2009 profit increased 69% to $49 million even with sales dropping, just from timeshare owners continuing to visit the timeshares they purchased.

Wyndham VRAP Chief Executive Officer Barry Robinson said, “There aren’t as many distressed properties in Australia as I would have expected to see,” He went on to say “I’m not sure whether that’s because our interest rates are still comparatively low for our market, so banks and operators are able to hold on to them because they can justify the returns.”

Timeshare Maintenance Fees Explained


Timeshare Relief hammerThe idea of maintenance fees makes sense.  They are mandatory fees that the resort management company or homeowners association charges its owners for the upkeep of the timeshare property.  These fees are usually defined as covering property taxes, utilities, insurance, and any other maintenance expenses.  But, they also need to meet the needs of future expenses like office furniture and appliances.

The amount of the fee varies widely.  Some fees are as little as a few hundred dollars a year, while others are several thousand.

Maintenance fees are generally levied on annual basis, however certain resorts may levy them monthly or biennially.   What you may not be told is the extent to which the annual maintenance fee will increase over the years.  What may be affordable now may not be with double-digital percentage increase every year.  And for new resorts, what you may not realize is that when a developer is in control, maintenance fees may be temporarily subsidized by the developer as a marketing tool while there is sales activity. After the homeowner association takes over, fees may quickly rise to unsubsidized levels.

Timeshare Relief Hears Another Story of Timeshare Dissatisfaction


Tracy & Richard met with Timeshare Relief in Ontario, California.  They had purchased their timeshare about ten years ago in 1999.  During that time their maintenance fees had more than doubled, and the timeshare experience was not what they expected.

When they tried to exchange their timeshare, their desired destinations were usually unavailable to them.

And when they had some financial issues, they thought that they could simply drop the timeshare by not paying for it.  They had heard from others that owning a timeshare was like a lease…that  they really didn’t own it.  Also, the timeshare was located in another country.  So, Tracy & Richard tried not paying.  A month later they received a nasty letter about collecting their payment and sending attorneys after them.

The last straw came when Tracy’s cousin was getting married.  They wanted to give her use of an exchanged timeshare in Las Vegas for the honeymoon.  But instead of exchanging their timeshare, Tracy found a timeshare for rent for $250 for a week.  Tracy found that the timeshare rental had been bought for $45,000.  So instead of exchanging their own timeshare for $1000 ($835 in maintenance fees and $165 in exchange fees), they went with the $250 rental.

What’s Your Timeshare Rescission Period aka Cooling Off Time?


We’ve all done it – been impressed by a salesperson’s charm and persistence and written a check for more than we knew we should.

What if you realize you made a mistake the next day?

Timeshare Relief appointmentSome states have “cooling off” time, a period after a purchase during which the purchaser has the right to return goods for a refund, or to cancel a contract without penalty.  The right to cancel a contract is governed by both state and federal law.  Please check with your attorney for specifics.  The remainder of this post is not intended to be legal advice.

There are very specific circumstances when these statutes and regulations apply; they do not apply to all circumstances.  Usually real estate, stocks or securities are not covered.

Under the U.S. Federal Trade Commission’s cooling-off rule, you have the right to cancel a purchase of $25 or more for a full refund as long as certain conditions are met:

If you make a purchase entirely by mail or telephone, the rule does not apply.When you initiate the sale at the seller’s permanent business location, the rule does not apply, even if the deal is closed in your home.Despite popular misconception, there is no cooling-off rule for automobile purchases. Make sure you want that car before you buy it.In order for the rule to apply, the purchase must be for personal, family, or household purposes.This rule isn’t applicable to purchases made to meet an emergency, such as a natural disaster or a home insect infestation. Nor does it apply to repairs and maintenance on your personal property.

If you just bought the timeshare, many states have a mandatory “cooling off” period when you can undo the deal and demand a return of your payment. Of course, those periods are usually only a week or 10 days, not months, so they relieve are only going to relieve short-term buyers’ remorse.  If you are a timeshare owner, you must be aware of your state’s laws.  Do not rely on a timeshare company to tell you what the law allows you to do.

If you have questions about your state’s cooling-off period, call your state attorney general’s office.  If you’ve experienced buyer’s remorse and you’ve passed your state’s cooling off period, then you may have to consider other options to let go of your timeshare purchase. Remember to Skip the Alcohol Before Attending Any Timeshare Presentation

I passed a billboard last week that took me a minute to understand.  Big bold letters called out:  DTWD.  My much more savvy teenage daughter pointed out that it meant “Don’t Text While Driving.”  Cute.  Of course, I can’t get the hang of texting while I’m sitting at my desk, but that’s ok.  I like the play on the slightly tired slogan, “Don’t Drink and Drive.”

Anyone who has ever imbibed a little too much alcohol at a party and later tried to remember exactly what happened the night before understands why.  Alcohol limits inhibitions.  It impairs our judgment.

More than one timeshare owner has reported free-flowing spirits before and sometimes even during the sales pitch, Timeshare Relief - Timeshare Resort Drinksonly to find themselves with a contract they don’t remember signing.  Not long ago, a hidden camera videotape revealed one company’s sales pitch included serving alcohol.  It’s not illegal, but it’s definitely not wise for the consumer to partake.

Seniors Choose Investments Carefully Especially If It Involves a Timeshare

Mixed-Use Development With Timeshares


Hospitality industry experts are saying that the concept of fractional ownership, timeshares and residences joining forces with hotels is a promising idea. At panel on timeshare at the Meet the Money conference in Los Angeles in May, panelists discussed the possibility of hotel properties converting space into fractional ownership or timeshare properties.

Mixed-use of hotels and timeshares can be a double win if the developers take advantage of hotel strengths. Maximizing the marketing overlap is what’s most important. Over-aggressive growth within the mixed-use spaces can be risky. Converting high end space into fractional ownership rather than timeshares is generally more successful. It is also important to reduce the amount of conversion and even try to go for as much as double the space through fractional ownerships, control is key. Existing infrastructure can make thing complicated,  you have to make sure kitchen and plumbing wiring is allowed and zoning regulations must permit two and three bedroom spaces.

CEO of Vacation Finance, Bob Waun, said, “We think there’s great opportunity in the resort sector, condo-hotels, fractional ownership and timeshare”. Timeshare Salespersons Form Class-Action Suit Against Vacation Charters Ltd.


Judgment ScalesA class action lawsuit has been formed combining roughly 275 people in a single suit against Vacation Charters Ltd. and, owner of the Split Rock Resort in Lake Harmony and other similar timeshare resorts, W. Jack Kalins. The disputes are due to overpaid taxes that each employee had to pay because they had been classified as independent contractors for selling timeshares. They were also not allotted any employee benefits such as medical coverage. Had the workers been treated as employees it would have obligated Kalins to provide them with benefits as well as pay a portion of their federal tax contributions.

The ruling by Judge Idee C. Fox is what will allow these over 275 salespersons to file in a single lawsuit instead of having to file individually. Attorney Mark Kearney, who will be working in favor of the workers, has estimated there will be a total of 21 million owed to the salespersons.

The ruling will be for salespersons who were employed from June of 2005 to the end of 2008. At the beginning of 2009 the timeshare company began paying salespersons as employees, providing benefits and paying part of their federal tax contributions. Attorney Steven Leventhal for Vacation Charters maintains that they have paid all their salespersons based on state law and that no violations were enacted on behalf of the timeshare company. Timeshare Relief Mends Hole in Pocketbook of Timeshare Owner

Timeshare Relief Video Testimonial – Donald and Debbie Ogden

Timeshare Relief Testimonial – Ron & Joyce Did Not Want to Pass On Debt To Their Heirs

Don’t You Love Your Kids? The Timeshare Hard-Sell


That’s the question that most rankled one prospective timeshare owner at a recent timeshare presentation.

“Of course I do,”  he answered.

“Then why wouldn’t you want them to grow up with such wonderful vacation memories?”

Granted, not every timeshare presentation uses manipulative sales techniques, but a few do.

Here are some common tools used during time share presentations:

An appeal to the emotions (see above)

Limited Time Offer  – if you walk out of the door, you can’t get the same deal tomorrow.

Everyone is doing it – some presentations are even known to plant another couple in the room who enthusiastically sign.

It will just take an hour – or two or three.  If they told you it would take three hours, you’d never agree.  You’ll notice there are no clocks in the room and sometimes alcohol is offered.  The bottom line is this:  the longer you are there, the more likely you are to buy.

A solution for that problem.  For every objection you come up, they will have at least four or five solutions.  You don’t have the money, they can help you find financing.

Promises, promises.  Regardless of what the salesperson says, if it isn’t written in the contract, it isn’t true.

Remember that timeshare salespeople are trying to make a living – sometimes their only source of income is the commission they earn from those sales (though they can be as high as 60% of the bill).  Still, buyer beware! Difficulty for Aspen Club’s Timeshare Developments


The Aspen Club & Spa is proposing to build 20 timeshare condos, 12 housing units and an underground parking garage. The Aspen City Council will be holding a public hearing on May 10 to discuss the redevelopments to the Aspen Club.

One concern during the last meeting that Aspen Mayor, Mick Ireland, has is that he would want to prevent the owners from selling properties that have not been completed. Another foreseeable problem that the current managing partner and general manager of the club, Michael Fox, has is that construction financing may be too difficult should the current partnership sell to another owner.

Yet another city council proposed condition is that the club’s current zoning, which allows for single-family homes, be removed upon approval. Fox has gone on to say that if the club is not approved to build these timeshares it is likely that the entire club will be demolished so that single-family homes can be put up in its place.

On top of all this, members of the city council expressed that they would want traffic levels to stay where they are and should traffic levels increase they will implement paid parking as well as a shuttle service. This redevelopment of the Aspen Club to include timeshares was first proposed in 2005, it was then withdrawn and resubmitted in 2008 when it received more promising approval for construction. Spain’s Timeshare Industry Is Set To Collapse


With a new court ruling in Spain on May 27th of 2010 there is expected to be up to 400,000 illegal timeshare contract compensation claims that could reach up to 2 billion €(euro). It has been ruled that a timeshare developer in Gran Canaria must pay back double the amount of the timeshare deposit by Magistrate D. Juan Carlos Socorro Marrero.  There are currently over 200 live claims for timeshare miss-selling in the Spanish court system against Anfi Del Mar. More claims were coming in at a rate of 10 per week before this ruling.

Spanish law also states that even if a property is sold and all encumberments and debts are passed on to the new owners those new owners will still be liable for new compensation claims. Within the industry it is said up to 200 developers that operate out of Spain, Balearics and canaries are trying to sell of timeshare resorts that have or soon will have actions brought against them.

Some brand name European timeshare developers have been taking illegal deposits up until as late as 2009. The European regulatory body representing timeshare owners in Europe has had some of its paid members break these same laws in the past. With this new ruling timeshare owners will finally get the chance to take on large corporate brand developers. As long as the timeshare development still exists you will be able to reclaim a double deposit if you paid after the cooling off period in 1996. China Provides Warning To Residents About Buying Timeshares


Timeshare Relief China Great WallIt seems as if timeshare companies are creating a stir in China and for Chinese citizens traveling abroad throughout the world.  We found an article from the China Daily that reports about an official from the Chaoyang district administration of industry and commerce and the attempts from their office to warn residents about timeshare scams.

Quoting the article:

“As many as 260 notice boards were set up in busy shopping malls like SOHO Shangdu and The Place, as well as in local communities in Chaoyang district to echo the administration’s month-long campaign to warn consumers about timeshare scams that was launched last weekend.”

A non-profit consumer watch group has received over 200 complaints this year about timeshare contracts in China.  Most of these complaints come from the larger cities in China.  Interestingly, as reported, court cases are difficult to win against the timeshare companies because Chinese law is not well-defined for such cases.

As we all know, there are going to be good and bad within the industry.  So many timeshare contracts are set up for timeshare owners to pay on a long term contract.  It’s enough that fraudulent companies need not enter the space to create more dissension and mistrust in the industry. Summer Timeshare Travel Vacation Scams


Timeshare VacationWith the summer vacation season drawing closer it is important to watch out for false advertisements so you don’t end up losing your vacation savings. The U.S. Federal Trade Commission averages 15,000 consumer complaints each year that related to timeshare or vacation rental frauds. It is important to at least know the basics regarding these unscrupulous scammer plots so you can avoid becoming a victim this summer.

The major problem lately is often related to timeshare properties. In these high pressure sales pitches you are nearly forced into purchasing a timeshare, sometimes when you don’t even want to. Those who have the income and means to technically afford a timeshare are roped in with free gifts, dinner or show accommodations and sometimes even just straight cash. They offer you these “free” gifts in return for your promise to hear them out and learn about timeshares. Often these sales professionals will even lie to you and explain that a timeshare can easily be rented out to cover the costs of ownership. This just is not true, with so many timeshares out on the market today the fact is that you can rent a timeshare out from the resorts or timeshare companies for much cheaper than it costs to own one.

Most people are just not ready to attend a timeshare presentation sales pitch and still walk away with the free gift. These timeshare salespeople are dead set on making you buy a timeshare and will simply not take no for an answer.

As if the “legitimate” timeshare sellers weren’t bad enough there are also illegal scammers who will flat out lie to get a meager upfront fee leaving you with even less money. These misleading people will advertise vacation rentals or timeshares that don’t exist or that they don’t own and charge an upfront fee for their service, once you pay this fee you never hear from them again. They will also prey on current timeshare owners who just want to get rid of their timeshare. They will promise that they have a guaranteed buyer waiting and once you pay them an upfront fee for their service they will disappear leaving you with that unwanted timeshare and being the victim of yet another scam.

Check out the Better Business Bureau report on any company that you do business with.  Also, make sure that the company has been in business for a long period of time.  Fraudulent companies cannot survive for very long. Timeshares: When an Investment is Not an Investment


We know that some timeshare owners enjoy their timeshares immensely — especially those with disposable income and want to know where they are going to vacation every year.  But, if you are not an owner and are considering to “invest” in a timeshare, you really need to consider the costs involved.

Many timeshare owners finance their timeshare purchase.  The interest payments and the total cost of repaying the loan can make the timeshare enormously unprofitable.  Timeshare loans are not like “normal” real estate mortgage loans on a primary residence or vacation home.  The interest rates are typically much higher and can go above 15%.

Even if you pay in full at the time of purchase, you lose the opportunity to invest that money into other financial interest-bearing instruments like CD, bonds, and money market accounts.  Imagine if you took $20,000 (the average amount of a timeshare in 2008) and put it into a modest CD that could net a small interest gain.  Over time, that could be hundreds or thousands of dollars that could be given to your children, instead of passing along a timeshare that continuously requires more fees.

The American Bar Association Family Legal Guide reminds potential owners that the investment is less of an investment when you consider that “your time-share contract will make you responsible to pay any increases in taxes, maintenance, or repairs. If you think any of these amounts are going to decrease, you’re in for a big surprise.”

A true investment in real estate means you can one day sell it and see a return on that investment.  With upwards of millions of timeshares up for resale, that will not be the case. Timeshare Sales Tactic – Limited Offer, Today Only!


Timeshare Relief clockWhether you’ve been sold a vacuum cleaner, or a gym membership, or even a timeshare property, you are familiar with this phrase:  “today only.”  In other words, buy it right this very instant.  Because if you don’t, the price is going to be astronomical and you will spend the rest of your life wishing you hadn’t walked away from such an incredible offer.

Except maybe it’s not exactly true.  If a deal is legitimate and profitable today, it will be tomorrow, too.  The only reason the buy it now price is such a big deal is so you won’t go home and think about it.  Or ask for advice from an attorney or accountant or someone else you trust.

Here’s one person’s experience.  The salesman said a membership, was $6000.00. We couldn’t afford that, so he said a 10 year was $3999.00 and you have 36 months to upgrade to the lifetime membership. $395.00 down & $91.00 a month. Plus $300.00 in maintenance fees per year.

The catch?  This deal is only good for the day you go.

We asked, “You mean we can’t go home and think about it, and let you know Monday.” He said “Absolutely not, the price then would be $12,000.00.”

It won’t surprise you to learn that two weeks later a friend of his went to the same presentation and the $3999 price was still good.  But just for today. What Timeshare Owners Need to Know About the BBB


If you have a question or a concern about a company you have had dealings with, or are considering using, whether it’s a contractor for your home or a company that you are buying a timeshare from, check out what the Better Business Bureau has to say about them first.

The Better Business Bureau (BBB) issued a reminder this week to remind anyone who is a timeshare owner to be aware of brokers who call out of the blue, ask for a fee and say they have prospective buyers.  Many of these are scams and remember, you can always check out a company with your local BBB.

In addition, Steven Cole, president of the Council of Better Business Bureaus says consumers are encouraged to obtain the names, addresses and telephone numbers for the lodgings, airlines and cruise ships advertised in a vacation promotion.

“Armed with that information, you can check with the BBB or a recognized travel organization to find out whether the business has been the subject of customer complaints. BBBs offer reports on travel-related businesses in both the U.S. and Canada,” said Cole.

The BBB defines its mission as “ensuring that high standards for trust are set and maintained. We exist so consumers and businesses alike have an unbiased source to guide them on matters of trust. We provide educational information and expert advice that is free of charge and easily accessible. “

Buying a Timeshare: Shamrock or Just Sham?

Ever follow a rainbow, looking for the pot of gold at the end?  Timeshare salespeople will guarantee you it is there. Given their often hours-long smoke and mirror show, their sometimes shady practices, maybe even a little alcohol, and you too might buy the map.  You have to pay for the journey too and the pot of gold recovery tools, and leprechaun bait, but it would be worth it in the end, right? Probably not. Sorry folks, for many, timeshares are fools gold. X never marks the spot. It’s not all bad though–at least you get the as-beautiful-as-a-rainbow scenery around the timeshare resort! If that’s all you need to be happy, you’re in luck.  But if you signed on for the investment, that jackpot at the end, you may be feeling a financial pinch very soon.

Before stricter regulation laws, timeshare developers used to sell people on the “investment” of their timeshares. “You can rent them out; you can sell them later; the maintenance fees are cheaper than buying a vacation outright each time.”  And after all, you do get a deed—you are made to feel you own property, which in most people’s minds mean security, investment, and money.  Well, it IS securely yours “in perpetuity,” meaning forever. But there’s no get-rich-quick here; it’s all downhill from the time you purchase  So, the next time someone tries to convince you there is an upside to timeshares, remember how rare rainbows are, and how you never quite find the end. A BBB Warning of St. Louis Timeshare Firm “Property Experts Marketing”


In the St. Louis area the Better Business Bureau (BBB) has identified another fraudulent timeshare resale and rental company. The company is claiming to be located in downtown St. Louis at a building that is vacant and padlocked. The company is Property Experts Marketing and is one among many of the scammer established companies that claim to sell or rent your vacation timeshare in return for upfront fees. Unfortunately once they receive the upfront payment, which can be up to thousands of dollars, from a timeshare owner there is no other action taken to get the timeshare sold. Often times a buyer or renter is promised to be ready and waiting but the timeshare is still never sold.

One timeshare owner has reported being scammed for $6,300. Another unfortunate victim had reported a loss of over $45,000 in fees with no sale or compensation received. The BBB can only offer limited advice to owners looking to sell a timeshare. The best thing to do is research, make sure you are dealing with a legitimate business that is not just acting as a front for illegal scams. Upfront fees WITHOUT WRITTEN GUARANTEES are the first sign of trouble, any significant fee that reaches even into the hundreds of dollars you should be very wary about. Try to contact the company you are dealing with and get any references available and contact them to make sure it is legitimate.

Out of the BBB’s investigation of this specific timeshare resale company they have not found out much. A representative of Property Experts Marketing while talking to a BBB investigator said that the company does operate at a suite on the seventh floor, when asked to meet the representative explained that he was leaving at that very moment. The company representative, John Orozco, said that his companies legal department would handle the BBB complaint filed by a Texan timeshare owner and that someone from the legal department would contact the BBB to clear up any misunderstanding, there has been no response since from Property Experts Marketing. Aspen Club Timeshare Development Approved


Aspen Club and SpaThe Aspen Club and Spa’s proposal to develop timeshares was passed on Tuesday June 2nd by a 3 to 1 vote by the Aspen City Council. Councilman Steve Skadron unexpectedly voted in favor of the timeshares, though still unsure whether any guarantees would be upheld to provide public benefits. This decision was made with the consideration that had these timeshare proposals not been approved for construction then the entire aspen club and spa may be closed down. The new developer would most likely demolish the aspen club to build homes in place of it.

The approved motion will allow the club to build on an additional 90,000 square feet and construct 20 new condos to be sold as timeshares, 14 housing units and a new 41 space underground parking structure. These new developments will take place close to the roaring fork river near the tennis courts. The proceeds from the timeshare sales will go towards improving other facilities at the club.

Mayor Mick Ireland and council member Skadron are deeply invested in making sure an athletic facility will remain accessible to local residents.  The club has also promised to allot a 0.25 percent assessment of the sale of timeshares to go towards a fund for enhancement of community health and wellness. This assessment is estimated to make between 250,000 and $500,000 throughout the 25 year duration, assuming the initial sales of timeshares are around $80 to $100 million. The club will also spend $5 million on capital and programming improvements.
